Professionalism when pressure conflicts with competence

Independent IBBC Capital draft content for self-study. Not affiliated with or endorsed by CFA Institute. New lessons await subject-matter review. No CFA designation or official PSM credit is awarded.

Learning goals

  • Diagnose the conduct from the facts and relevant professional duties.
  • Recommend a documented preventive and corrective response.

Draft · approximately 60 minutes, excluding further revision.

Decision case · fictional facts

A fictional analyst is asked to launch an unfamiliar structured-credit strategy immediately. Marketing copies a competitor’s research without attribution and offers an expensive issuer-funded trip tied to favorable coverage. A supervisor says a permissive local practice overrides professional duties.

Duties and competing interests

Identify applicable obligations and follow the stricter requirement where governing rules and professional standards conflict. Seek legal/compliance advice, decline participation and dissociate from known misconduct as appropriate. Merely following a supervisor does not remove personal responsibility.

Independence can be compromised by issuer-paid benefits; misleading attribution and plagiarism undermine truthful communication. Competence requires sufficient knowledge and skills for the responsibility, maintained as tasks evolve. Recognize gaps and obtain training or qualified support before acting outside capability. Misconduct concerns extend beyond a poor investment outcome.

Decision, controls and remaining uncertainty

Decline the coverage-linked trip, replace copied content with properly attributed or independently produced analysis, and delay unsupported strategy claims. Assign qualified review and training before taking responsibility for the unfamiliar product.

Document and escalate the conflict. Decide how to dissociate if the firm persists; external reporting depends on applicable obligations and circumstances, not a blanket assumption that every concern mandates public disclosure.

Formula and assumptions

Identify facts → duties → affected parties → feasible action → evidence and follow-up

Compare with the model response after drafting
  1. Decline the coverage-linked trip, replace copied content with properly attributed or independently produced analysis, and delay unsupported strategy claims. Assign qualified review and training before taking responsibility for the unfamiliar product.
  2. Document and escalate the conflict. Decide how to dissociate if the firm persists; external reporting depends on applicable obligations and circumstances, not a blanket assumption that every concern mandates public disclosure.

Errors to catch

  • Treating disclosure, client consent or a supervisor’s instruction as permission for prohibited conduct.
  • Inventing missing facts or treating a potential concern as a proven legal violation.
