Ethical judgment requires more than a legal minimum

Independent IBBC Capital draft content for self-study. Not affiliated with or endorsed by CFA Institute. New lessons await subject-matter review. No CFA designation or official PSM credit is awarded.

Learning goals

  • Which action best addresses the central case issues?
  • Explain why the intellectual analysis remains another author’s work applies to this case.
  • Identify the case-specific assumption or failure mode before taking action.

Draft · approximately 30 minutes, excluding further revision.

Shared case and decision context

A candidate prepares a client pitch using a competitor’s original valuation chart without attribution. Local marketing law does not expressly forbid the copying. A supervisor says silence in the law makes the conduct acceptable. The candidate has time to correct the pitch before release.

Economic or professional mechanism

Professional obligations can demand conduct beyond legal minimums. Distinguish an ethical duty from an enforceable law and determine which requirements apply to the actual activity. Crediting intellectual work preserves truthful communication; merely changing formatting does not turn another analyst’s original analysis into your own.

Apply, challenge and communicate

Stop release, obtain permission where needed and attribute the chart or replace it with independently produced analysis. Preserve a record of the correction and escalate if the supervisor insists on deception. Approval by a manager does not transfer away personal responsibility; the case turns on misrepresentation, not whether the copied chart predicts returns accurately.

Professional conduct review is an evidence-based process

CFA Institute enforces member/candidate obligations through its professional conduct framework under its governing documents and current Rules of Procedure. Matters can arise from required disclosures, complaints or other information; an allegation is not itself a finding. Investigation and peer review evaluate evidence and provide the procedures applicable to the case.

A fictional candidate receiving a conduct inquiry should preserve relevant records, respond truthfully and cooperate within applicable legal constraints. She should not assume an employer’s acquittal resolves the professional body’s separate inquiry. Sanctions can affect membership, designation use or candidacy depending on the finding and governing process; consult current official rules rather than inventing a universal timetable or guaranteed result.

Formula and assumptions

Identify applicable obligations → examine facts → select and document compliant action

Case analysis with explicit assumptions

  1. A candidate prepares a client pitch using a competitor’s original valuation chart without attribution. Local marketing law does not expressly forbid the copying. A supervisor says silence in the law makes the conduct acceptable. The candidate has time to correct the pitch before release.
  2. Method: Identify applicable obligations → examine facts → select and document compliant action
  3. Case result: Correct attribution and permissions before release.

Errors to catch

  • Do not replace the stated assumptions with an unstated shortcut. Reconcile units, timing and the claim being valued or duty being assessed.
  • Only whether the chart was profitable is not a defensible conclusion for these case facts.
